New Law with Big Implications

A new law is going into effect November 1st that will have important implications for anyone involved in interviewing and hiring.

New York is joining Philadelphia and Massachusetts in legislation prohibiting both companies and the recruiters that serve them by asking job candidates about their salary.  The intention is to prevent the exploitation of those that are underpaid (primarily women).

I’ve often wondered what difference it makes what salary someone is currently making if they have the qualifications to do the job I am recruiting for.  No company has to hire a candidate they do not feel has a resume that substantiates the salary they are requesting.

The penalties for asking about salary are severe – Penalties will range from $125,000 for an unintentional violation, up to $250,000 for a “willful, wanton or malicious act.” Wow…that ought to result in widespread compliance.
